Q. How does the process work?
A.
First, make an appointment to come in. Or, fill out the form
located
here. After your payment and information are
received, we
will prepare and file the summons & complaint and
have your spouse served by the method you choose (in-person, email, or
mail).
After your spouse signs his or her papers,
you will need to sign the final papers for filing with the court. We can
handle this by mail or email.
After that, it's just a matter of waiting for the court
to issue the judgment. If all goes
well, your New York uncontested divorce can be completed in as little as
6-8 weeks from the start.
Q. How long will my New York uncontested divorce take?
A. That depends on your spouse. The faster he or she signs &
returns the necessary paperwork, the faster your divorce can be
finalized. It can be as little as 6-8 weeks, or as much as 3-4
months or more.
Q. What if my spouse refuses to sign the papers?
A. You can still get your divorce without your spouse's cooperation,
but we may need to have him/her professionally served and wait at least 40 days from the date he/she
was served to proceed with the final steps. This will add to your
costs.
Q. Will I need to go to court?
A. If your divorce remains uncontested, you will not have to go to
court at all. In fact, you do not even need to come in to our
office. Ever. We can handle the entire process by mail, phone,
email, etc. The only exception is in the rare event that the court
orders an inquest, which may be required if there has been any
history of domestic violence and/or orders of protection.
Q.
Do you offer payment plans?
A. Yes. 50% down payment is due
in order to get your case started. After your spouse signs & returns his/her affidavits, you will
need to make the final payment when signing papers to complete the
filing process.
Q. What happens if an uncontested divorce becomes
contested?
A. This is always a possibility. After your spouse is served with
the divorce papers, he or she can decide to contest the divorce,
meaning that they do not agree with the specified grounds, the
relief sought, demands for support, or the terms of property
division or child custody arrangements. If this happens, then your
uncontested divorce becomes contested and it will cost you (and your
spouse) significantly more legal fees (and time, including court
appearances).
Q. I don't know where my spouse lives. Can I
still get a divorce?
A. Yes, but it is very expensive due to extra costs
such as motion
preparation and filing, affidavits by a process server, and
court-ordered advertising. Your total can reach as much as $3000.
Q. What is the advantage of third-party personal service?
A. If you have your spouse personally served by our
process server, then we have proof that he/she received notice of the
divorce. This will allow us to finalize your divorce even if your
spouse refuses or forgets to sign & return the papers. You'll save
money without personal service, but your case will expire if your spouse
delays long enough. Therefore, we suggest that you choose personal
service unless you are absolutely sure that your spouse will sign
& return the papers to us.
